Terms and Conditions

These terms and conditions apply to all coaching, mentoring, self-development counseling, and advisory services provided by Carol Xavier of Life Coach Carol to any individual or organization and constitute the contract for the service to be provided by Carol Xavier for the client. The terms ‘counseling’, ‘coaching’, and ‘mentoring’ as used here cover self-development, life coaching, personal coaching, executive coaching, and business coaching for clients.

By purchasing services from Life Coach Carol, you are confirming that you have read and agreed to each statement and wish to proceed.

1. Services and Communication

All services and communication, email or otherwise, delivered by Carol Xavier, as well as information on this website (lifecoachcarol.com), are meant to help you work through life stressors and emotional roadblocks to move forward into happiness, well-being, and abundance. Self-development counseling is not a substitute for professional mental health care or medical care.

2. Coaching Disclaimer

In committing to working with Carol, you acknowledge the following:

  • The services you will receive are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. Carol is not acting as a mental health therapist or a medical professional.

  • Coaching/counseling/mentorship is currently an unregulated industry. However, Carol is undergoing accreditation from the International Coach Federation (ICF). The ICF is a globally recognized organization dedicated to advancing the coaching profession by setting high standards, providing independent certification, and building a worldwide network of trained coaching professionals.

  • You are fully responsible for your well-being during your coaching sessions and subsequently, including your choices and decisions.

  • The services provided are not a substitute for mental health counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment.

  • All comments and ideas offered are solely for the purpose of aiding you in achieving the defined goals you create. Results are not guaranteed.

  • The coaching services/sessions involve personal development, relationship development, career, and/or business. There is no promise of outcomes, including but not limited to trauma recovery, personal introspection, increased personal happiness, career progression, profitability, and/or business success.

3. Data Protection and Security

Your information remains confidential unless you state otherwise in writing. If you report child abuse, elder abuse, or neglect, or threaten to harm yourself or someone else, necessary actions may be taken, and your confidentiality agreement may be limited. If ordered by a court to provide information or to testify, Carol will do so to the extent the law requires.

You understand that the use of technology is not always secure, and you accept the risks of confidentiality in the use of email, text, phone, WhatsApp, Skype, and any other technology.

4. Waiver

You hereby release, waive, acquit, and forever discharge Carol Xavier of Life Coach Carol, any agents, successors, assigns, personal representatives, executors, heirs, and employees from every claim, suit, action, demand, or right to compensation for damages you may claim to have or that may arise.

5. Terms & Conditions for Sessions

In return for the fees payable by the client (or by a third party on their behalf), Carol agrees to provide the service as described below and in accordance with these terms and conditions. The client agrees to pay fees for the service on these terms. Participation in the first session constitutes acceptance of these terms and conditions.

6. Format of Sessions

Sessions are conducted via phone or internet: either via ZOOM, Skype, FaceTime audio, WhatsApp audio, or by telephone direct. The coach is open to other formats by mutual agreement. Carol is responsible for ensuring availability for consultation at agreed times. The length of each session is 60/90 minutes confirmed at the time of booking and paid for accordingly.

7. Session Fees

Carol’s current fees are stipulated on the website and made clear at the time of booking. She reserves the right to change these from time to time. Any payments for sessions paid in advance are honored even if prices have risen between the point of booking and the time of the session.

8. Dates and Times of Sessions

The date and time of the first session and any subsequent sessions will be registered on the online agenda maintained on the website. Carol agrees to maintain her availability to match that presented by the website and to honor the sessions booked through the online bookings platform.

9. Payment Terms

Fees can be paid through Interac e-transfers or international remittances. Receipts and/or invoices are available upon request.

Fees are payable in advance of initiating a coaching session/package unless otherwise agreed. If the client has used their sessions, no refunds will be given. If the client misses their session, no refunds will be given. Where payment is required on receipt of invoice rather than in advance, a charge may be levied for late payment.

10. Rescheduling Sessions

If a client needs to reschedule a coaching session, they should provide at least 2 hours' notice. No refunds will be given for unused sessions unless 2 hours' notice has been given. In exceptional circumstances, Carol may need to rearrange a session and will give 2 hours' notice where practical.

11. Confidentiality

Personal or business information supplied by clients in sessions will be treated as confidential and not disclosed to a third party without prior permission, save where required by law or where action is necessary to prevent harm.

12. Early Termination

In exceptional circumstances, such as illness or unavailability due to bereavement, inappropriate behavior by the client, conflict of interest, or other reasons, Carol can decide to terminate service early. Clients will be given reasonable notice where practicable and refunded any advance payments for sessions not yet provided.

13. Responsibilities

Carol will seek to enable the client to improve their quality of life or business success and to achieve desired outcomes. However, the client has sole responsibility for taking important decisions. Carol has no liability for any loss incurred by the client following the commencement of sessions.

14. Variation of Terms & Conditions

Carol may change any of these terms or conditions, including the session fee, by giving the client one week’s notice in writing. If the client no longer wishes to proceed with further sessions, they may withdraw immediately by giving notice in writing and will be entitled to a full refund for sessions not yet provided.
